At Firmatek, LLC (collectively, “Firmatek,” “we,” “us” or “our”), privacy is a top priority and we are firmly committed to preserving the privacy of those who visit this site (the “Site”). This document will outline how we gather and utilize various sources of information obtained during your visit to the Site.
This Privacy Policy communicates how, when, and why we gather information about our customers and what we do with it. This Privacy Policy applies solely to information collected at this Site, and is made a part of and incorporated into the Terms and Conditions.
This Privacy Policy does not apply to other websites to which it may link. You agree that your use of the Site signifies your assent to this Privacy Policy. If you do not agree with this Privacy Policy, you are not authorized to use the Site.
Capitalized terms used but not defined herein shall have the meaning ascribed to them in the Terms & Conditions Agreement.
Information Collected
Personal Information
If you register with the Site and/or place an order for Services or Equipment through the Site, we may ask you for your name, e-mail address, shipping address, telephone number and credit card information or certain other personally identifiable information about yourself (“Personal Information”). We use this information to process and fulfill your Order or Statement of Work and to notify you of your Order status. All archived credit card information is maintained in a secure and safe environment. Telephone numbers and e-mail addresses are used to contact you regarding your Orders. In addition, when you respond to a survey, questionnaire, or other promotional feature, we may ask you for your name, address and email address or other personally identifiable information about yourself.
We do not collect any Personal Information about you unless it is voluntarily provided by you. Firmatek will never sell, rent or share your Personal Information, including your e-mail address, with any third parties for marketing purposes without your express permission.
Non-personally identifiable information
In addition, we may also collect non-personally identifiable information, such as the IP host address, pages viewed, browser type, duration and frequency of visits, and other data, and may aggregate any information collected in a manner which does not identify any individual (“Aggregate Information”).
Information obtained in connection with the Site may be intermingled with and used by us in conjunction with information obtained through sources other than the Site, including both offline and online sources.
Flight data. Flight Data may be uploaded to Firmatek’s Aerial Intelligence Service before, during, or after the Flight.
Geolocation data. The AIS provides features that enable Firmatek to tailor customer experience based on location (“Location-based Services”). To use Location-based Services, you must allow Firmatek access to your position through your mobile device, which Firmatek may accomplish through a variety of means, including GPS location, if available. If you choose to disable location-based services, you will not be able to utilize certain features of the AIS.
How We Use Your Information
We will not share or disclose your information to anyone except as described in this Privacy Policy. We understand clearly that your information and your trust is one of our most important assets. We store and process your information on computers that are protected by physical as well as technological security devices.
We use Personal Information in order to give you a more enjoyable and convenient experience while visiting and using our Site and to help us identify and/or provide information, products or services that may be of interest to you. We use your Personal Information to support and enhance your use of the Site and its features, including without limitation: fulfilling your Order; providing customer service; and otherwise supporting your use of the Site.
We may also track your past purchases to provide you with a personalized profile of your purchasing history. In addition, we may notify you about new services or products or special promotional programs, or send you offers or information.
Please note that we may also share information about you or your Order if we believe in good faith that disclosure of specific information is necessary to (a) resolve disputes, investigate problems, or enforce our Terms of Use, or (b) protect and defend our rights or property or the rights and property of you or third parties.
We may also share information about you when forwarding Digital Millennium Copyright Act (“DMCA”) infringement notifications, take down notices and counter notices. By submitting a DMCA infringement notification, counter notice or other communication, you consent to have this communication forwarded to the person or entity that stored or transmitted the content addressed by your communications. For notices other than DMCA infringement notifications and counter notices, you may request that we edit out your name and contact information. However, DMCA infringement notifications and counter notices (including any personal information set forth in the notifications) will be forwarded as submitted to us without any deletions.
If you are located in the European Economic Area, we only process your Personal Information based on a valid legal ground, including when:
- You have consented to the use of your Personal Information;
- We need your Personal Information to provide you with the Firmatek’s products and services, including for account registration or to respond to your inquiries;
- We have a legal obligation to use your Personal Information;
- We or a third party, have a legitimate interest in using your Personal Information. In particular, we have a legitimate interest in using your Personal Information for product development and internal analytics purposes, and otherwise to improve the safety, security, and performance of our products and services. We only rely on our or a third party’s legitimate interests to process your Personal Information when these interests are not overridden by your rights and interests.
Affiliates, Consultants, Third Parties
Unless you specifically consent to the disclosure of your Personal Information, aside from us, only our affiliates, technical consultants, third party auditors and other third parties who make our Site available, enhance its functionality, assist with the processing of your Orders, or provide associated products or services and/or who deal with you in delivering services or products and we require them to agree that they are covered by this Privacy Policy.
Law enforcement and investigations
Please note that Firmatek reserves the right to and may disclose Personal Information about you in response to (a) requests from local, state or federal law enforcement officials; (b) any judicial, administrative or similar proceeding or order, such as subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, the Site rules or policies, or the rights of third parties or to investigate any suspected conduct which we deem improper.
Change of control
Please also note that we do reserve the right to transfer your Personal Information and other information as an asset in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization, stock sale or other change in control. In such a circumstance the Transferee would be bound by the terms of this Privacy Policy.
Non-personally identifiable information
We use non-personally identifiable information in the aggregate, such as by publishing a report on trends in the usage of the Site, so that we can improve the Site and for business and administrative purposes. We may also use or share with third parties for any purpose aggregated data that contains no personally identifiable information.
Please note that, while the Aggregate Information we provide will not identify you personally, in some instances third parties may be able to “de-anonymize” aggregate data to identify you personally based on additional information they have about you or that they receive from third parties. While we do not intend for third parties to de-anonymize the aggregate data we provide, if you are concerned about potentially being personally identified, you should not use the Site.
Social Sharing Features
The Site may offer social sharing features and other integrated tools, such as the Facebook, Twitter and Pinterest buttons (e.g., “Like,” “Tweet” and “Pin It”), which let you share actions you take on the Site with other media. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. Use of Cookies
Our Site may pass a “cookie” (a string of information that is sent by a web site to be resident on your system’s hard drive, and/or temporarily in your computer’s memory blocks). The purpose of a cookie is to tell the web server that you have returned to a particular page. Firmatek may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits. Persistent cookies can be removed. This information may include Internet Protocol address or other device address or ID, web browser and/or device type and operating system, the web pages or services that referred you to our website or the Online Services, the pages you view, and the dates and times that you visit, access, or use our website or the Online Services. Please review your web browser “Help” file to learn the proper way to modify your cookie settings. You may set your browser to decline cookies. If you do so, however, you may not be able to fully experience some interactive features of the Site.
Web Beacons
For our Site, a “web beacon,” also sometimes called a pixel tag or transparent GIF, is an object that is embedded in a web page. It is usually invisible to you, but allows website operators to check whether you have viewed a particular web page or email communication. We may place web beacons on our Site and in emails or text messages we send to you.

How We Protect Your Information
We are committed to protecting the information we receive from you. However, Firmatek will not be liable for disclosures of your Personal Information due to errors in transmission or unauthorized acts of third parties. We have used commercially reasonable efforts to prevent unauthorized Internet access to visitor data retained in our servers; however, due to the inherent open nature of the Internet, Firmatek cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. Users must accept all risks associated with any data transmission, including the risk that their Personal Information may be intercepted in transit.
Your profile is password-protected so that only you have access to your account information. In order to maintain this protection, do not give your password to anyone. Our staff will never proactively reach out to you and ask for any Personal information, including your password. You should never share devices. This will help protect your information entered on public terminals from disclosure to third parties.
The Site encrypt your credit card number and other Personal Information using secure socket layer (SSL) technology to provide for the secure transmission of the information from your PC to our servers. In addition, only those employees and third parties who need access to your information in order to perform their duties are allowed such access.

You have certain choices with respect to your Personal Information:
You may, of course, decline to share certain Personal Information with Firmatek, in which case Firmatek may not be able to provide some of the features and functionality found on the Online Services or our website to you.
You may update, correct, or delete your profile information and preferences at any time by accessing your account preferences page through the Online Services. Please note that while your changes may be reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics.
You may have the ability to opt-out of receiving marketing communications from us by updating your account settings through the Online Services or clicking on links embedded in such messages.
If you are located in the European Economic Area, you may have additional rights described below. These rights may be limited in some circumstances by local law requirements. You may exercise these rights by contacting us as indicated at the bottom of this Policy.
- You have the right to request access to and receive information about the Personal Information we maintain about you, update and correct inaccuracies in your Personal Information, restrict or object to the processing of your Personal Information, have the information anonymized or deleted, as appropriate, or exercise your right to data portability to easily transfer your Personal Information to another company. In addition, you may also have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work or where an incident took place.
- You have the right to withdraw any consent you previously provided to us regarding the processing of your Personal Information, at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before your consent withdrawal.
Accessing and Updating Your Personal Information and Preferences
If you are a registered user, you may access and update your registration information and your preferences to receive e-mail or other communications from us by sending an email to marketing@firmatek.com
We will take commercially reasonable steps to implement your opt-out requests promptly, but you may still receive communications from us for up to ten business days as we process your request.
While we make efforts to accommodate requests to restrict our use of your information, we reserve the right to delete all or any portion of customer information if we are not able to reasonably accommodate a requested restriction.
Information Retention
To preserve the integrity of our databases, our standard procedures call for us to retain information submitted by users for an indefinite length of time. We understand your submissions as consent to store all your information in one place for this indefinite length of time, if we so wish. If required by law, we will nullify user information by erasing it from our database. We will also respond to written user requests to nullify account information.
Enforcement and Dispute Resolution
Firmatek uses a self-assessment approach to assure compliance with this Privacy Policy and periodically verifies that the Privacy Policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented and accessible. We encourage interested persons to raise any concerns using the contact information provided and we will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of Personal Information.
Children’s Privacy and Parental Controls
These Site are not intended for persons under the age of 18, and we have no intention of collecting or soliciting Personal Information from persons under the age of 18. If you are not 18 or older, you are not authorized to use the Site. Parents should be aware that there are parental control tools available online that you can use to prevent your children from submitting information online without parental permission or from accessing material that is harmful to minors. If a child under age 18 has provided us with Personal Information, we will use all reasonable efforts to delete such information from our database.

Use of the Site is governed by, and subject to, the legal notices contained in our Terms and Conditions. Your use, or access, of the Site constitutes your agreement to be bound by these provisions. IF YOU DO NOT AGREE TO THESE TERMS YOU MAY NOT ACCESS OR OTHERWISE USE THE SITES.

We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time. Our Site is maintained in the United States of America. By using the Site, you authorize the export of Personal Information to the USA and its storage and use as specified in this Privacy Policy.

The Online Services are hosted in the United States. If you are visiting from the European Economic Area or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your Personal Information to the United States, which does not have the same data protection laws as your jurisdiction, and by providing your Personal Information you consent to the transfer of your Personal Information to the United States as indicated above.
